Introduction

1.1 Within this procedure, the term ‘student’ includes current students and former students who are eligible to submit an academic appeal within the timescales set out in Section 10.

1.2 An academic appeal is a request for the University to review a decision made by an academic body about a mark, grade, progression decision or award.

1.3 Academic appeals can only be considered where a student believes there are valid grounds for appeal, as set out in Section 9. An appeal is not an opportunity to challenge academic judgement or request a re-mark because you disagree with the mark or grade awarded.

1.4 Assessment marks and grades remain provisional until they have been confirmed by the relevant Board of Examiners or Award and Progression Panel. Appeals cannot be considered against provisional marks or grades.

1.5 You have the right to submit one academic appeal against a decision of a Board of Examiners or Award and Progression Panel, provided that your appeal meets the requirements of this procedure.

1.6 Further guidance on submitting an academic appeal is available on the Academic Appeals and Student Complaints webpage.

1.7 A glossary explaining some of the terms used in this procedure is available at Appendix 1.

2. Principles

2.1. This procedure is based on the principles of fairness, transparency and proportionality and is aligned with the UK Quality Code for Higher Education, and the Office of the Independent Adjudicator for Higher Education (OIA) Good Practice Framework for Handling Complaints and Academic Appeals.

2.2. We will consider and implement reasonable adjustments at any stage of the academic appeals process to support you to engage with the procedure.

2.3 You will not be disadvantaged or treated unfairly for submitting an academic appeal in good faith.

2.4 We expect you, and anyone supporting or representing you, to engage with the academic appeals process reasonably and respectfully. We recognise that you may be experiencing difficult circumstances when using this procedure. However, we expect all communications and interactions will remain courteous and appropriate. We have a duty to provide a safe and respectful environment for staff and students. We will not accept behaviour that is abusive, threatening, harassing, intimidating, vexatious, or otherwise inappropriate towards staff or others involved in the academic appeals process. Where behaviour affects the wellbeing of others or prevents the effective operation of the process, we may take appropriate action in line with the Student Community Code of Conduct and may put reasonable measures in place to protect those involved and support the fair and effective administration of the process.

2.5 The outcome of an academic appeal will depend on the circumstances of the case. Where an appeal is upheld, the outcome will usually involve practical remedies, such as the opportunity to retake an assessment or reconsideration of the original decision by the relevant academic body.

3. Privacy and Confidentiality

3.1 We will handle your academic appeal sensitively and in accordance with Data Protection legislation and the University’s Student Privacy Notice.

3.2 Information about your academic appeal only be shared with people who need it to consider, investigate or reach a decision on your appeal, or where disclosure is required by law or is in the public interest. Everyone involved in the appeal is expected to respect its confidentiality.

3.3 By submitting an academic appeal, you understand that we may need to share the information you provide with relevant members of staff so that your appeal can be considered. This may include members of the relevant School and / or Professional Service, Board of Examiners, Award and Progression Panel or Academic Appeals Group.

3.4 If your academic appeal includes particularly sensitive information and you have concerns about how it will be shared, please contact the Governance and Legal Team at appealsandcomplaints@glos.ac.uk before or when you submit your appeal. We will discuss whether it is possible to limit the disclosure of sensitive information while still allowing your appeal to be considered fairly.

3.5 In some circumstances, we may not be able to consider your appeal if we cannot share enough information with the relevant people involved in the process. If this happens, we will explain why and discuss the options available to you.

3.6 Please only include personal information that is relevant to your appeal. If you include personal information about another person, you should only do so where it is necessary and appropriate, and where possible, you should have their permission to share it.

4. Who can use this procedure?

4.1 You can use this procedure if you are:

a current student of the University; or

a former student, provided you submit your appeal within the timescales set out in Section 10.

4.2 It is expected that you will submit your academic appeal yourself. If you cannot do this, we may, in exceptional circumstances, accept an appeal from someone acting on your behalf.

4.3 If you would like another person, such as a family member or representative, to submit or discuss an academic appeal on your behalf, you will need to:

explain why you cannot raise the appeal yourself;

complete a third-party consent form (available from appealsandcomplaints@glos.ac.uk); and

confirm that you agree with the appeal being submitted on your behalf.

You will normally still be expected to take part in the academic appeals process, with support from the third party where appropriate.

4.5 You may be accompanied, supported or advised at any stage of the academic appeals process by another member of the University community. This could include:

a current student of the University;

a member of University staff; or

a representative or elected officer of the University of Gloucestershire Students’ Union.

4.6 If you would like someone to represent or act on your behalf during the appeals process, that person should be a member of the University community. We will also consider requests for someone outside the University community where appropriate, including where this is needed as a reasonable adjustment or to support your participation in the process.

4.7 If you are under 18, you should be accompanied by a parent, guardian or another responsible adult.

5. Advice and Support

5.1 You can seek independent advice and support from the Students’ Union at suadvice@glos.ac.uk.

5.2 If you need support with your wellbeing, accessibility or other aspects of your student experience, you can contact the Student Centres.

5.3 If you have questions about how the academic appeals process works or need guidance on using this procedure, you can contact us at appealsandcomplaints@glos.ac.uk.

What is an Academic Appeal?

6.1 An academic appeal is a request for the University to review a decision made by a Board of Examiners or Award and Progression Panel about:

an assessment mark or grade;

progression to the next stage of your programme; or

an award decision.

6.2 An academic appeal is not a way to challenge academic judgement.

6.3 Academic judgement means the professional judgement made by academic staff when assessing the quality of your work, assigning marks or making academic decisions. You cannot appeal simply because you disagree with the mark, grade or outcome awarded, and you cannot request a re-mark through this procedure.

What can you appeal?

7.1 You can submit an academic appeal if you believe that one or more of the grounds for appeal set out in Section 9 apply.

7.2 You should explain clearly why you believe your appeal meets the relevant grounds and provide any supporting evidence.

Matters not covered by this procedure

8.1 The Academic Appeals Procedure cannot be used for matters that are covered by another University procedure. These include:

complaints about teaching, supervision, academic advice or other services provided by the University;

concerns about another student’s behaviour;

complaints about professional suitability, fitness to practise or supported study matters;

appeals against provisional marks or grades;

disagreement with academic judgement.

8.2 If your concerns relate to a service or experience during your programme of study, you may be able to raise these through the Student Complaints Procedure.

8.3 If you submit an appeal which is more appropriately considered under another University procedure, we will explain this and advise you on the next steps. Where appropriate, we may consider matters under more than one procedure.

9. Grounds for Appeal

9.1 You can submit an academic appeal if you believe one or both of the following apply:

a) Exceptional Circumstances

There were circumstances which affected your performance and which, for good reason, you were unable to tell the Board of Examiners or Award and Progression Panel about before it made its decision.

You should provide relevant evidence to support your appeal where appropriate. Medical evidence should be provided at the time the circumstances occurred. Retrospective medical evidence will only normally be considered where there is a reasonable explanation for why it was not available earlier.

b) Administrative Error or Procedural Irregularity

There was a significant University administrative error or procedural irregularity during the assessment process which may have affected the mark, grade or decision reached.

9.2 You cannot appeal against academic judgement. This means that you cannot appeal because you disagree with the professional judgement of academic staff when assessing your work or making an academic decision.

9.3 If your appeal includes concerns about teaching, supervision, academic advice or other services provided by the University, these should be raised through the Student Complaints Procedure at the time they occur. Such concerns cannot normally be introduced later as grounds for an academic appeal.

10. Timescales

10.1 You should submit an academic appeal within 20 working days of the Board of Examiners, Award and Progression Panel, or other academic body at which the decision you are appealing was confirmed.

10.2 You should raise concerns as soon as possible with your School where appropriate, as early discussion may help resolve issues or clarify whether you have grounds for appeal. However, seeking informal advice or resolution does not extend the deadline for submitting a formal academic appeal.

10.3 We may consider appeals submitted outside this timescale where there is a good reason for the delay and you can provide supporting information.

10.4 We aim to complete the consideration of a formal appeal, including any review stage, within 90 calendar days. To help us meet this timescale, you should provide any information requested and respond within the deadlines provided.

10.5 In some circumstances, it may not be possible to complete an appeal within 90 calendar days, for example where the appeal is complex, involves a number of issues, or requires information from other people or teams. If there is a delay, we will explain the reason, keep you updated on progress and provide an expected timescale for completion.

10.6 For the purposes of this procedure, a working day means Monday to Friday, excluding bank holidays and University closure days.

11. Stages of the Academic Appeals Process

11.1 If you think you have grounds for an academic appeal, the process normally has three stages:

Early Local Resolution: Raise your concerns with the relevant Module Tutor, Academic Course Leader or School as soon as possible to see whether the matter can be resolved informally.

Formal Academic Appeal: If the matter cannot be resolved informally and you believe you have valid grounds for appeal, you can submit a formal academic appeal.

Review: If you remain dissatisfied with the outcome of your formal appeal, you may be able to request a further review, depending on the outcome of your appeal and the grounds set out in this procedure.

12. Early Local Resolution

12.1 Before submitting a formal academic appeal, you should discuss your concerns with the relevant School or academic team where appropriate. This may include, for example, a Module Tutor, Academic Course Leader or another appropriate member of staff.

12.2 Early resolution provides an opportunity to clarify the decision you are concerned about, understand the information considered, and resolve any issues where possible without the need for a formal appeal.

12.3 You may also wish to seek independent advice and support from the Students’ Union at suadvice@glos.ac.uk before submitting an academic appeal.

12.4 If your concerns cannot be resolved informally, or if informal resolution is not appropriate, you may submit a formal academic appeal if you believe you have valid grounds under Section 9.

13. Formal Academic Appeal

13.1 If you wish to submit a formal academic appeal, you must complete the Academic Appeals Form and email it to the Governance and Legal Team at appealsandcomplaints@glos.ac.uk within the timescale set out in Section 10.

13.2 Your Academic Appeals Form should include / explain:

your name and University student number;

your course title;

the decision you are appealing, including the relevant module, assessment or award/progression decision;

the grounds for appeal you are relying on;

why you believe those grounds apply;

any relevant supporting evidence; and

the outcome you are seeking.

If you are studying through a collaborative partner organisation, you should also provide details of the partner organisation and any outcome from their internal appeal process.

13.3 Please keep your appeal to a reasonable length and focus on the key issues you would like us to consider. You should provide relevant evidence when you submit your appeal, such as correspondence or other documents that support your case. If we need further information or clarification, we will let you know what is required and provide a reasonable timeframe for you to provide it.

13.4 We will normally acknowledge receipt of your appeal within 5 working days. If you have not received an acknowledgement within this timeframe, please contact appealsandcomplaints@glos.ac.uk to confirm that your appeal has been received.

13.5 Once your appeal has been received, we will check whether it meets the requirements of this procedure.

13.6 An appeal may not be eligible for consideration where:

it does not identify a valid ground for appeal;

it is only challenging academic judgement;

it has been submitted outside the deadline without a good reason;

there is insufficient information or evidence to support the grounds of appeal.

13.7 If your appeal is eligible for consideration, the relevant School and where appropriate, Professional Service, will be asked to provide information and a response to the issues raised.

13.8 You will be given an opportunity to comment on any response provided before your appeal is considered by the Academic Appeals Group.

14. Consideration by Academic Appeals Group

14.1 Your appeal will be considered by an Academic Appeals Group made up of members who have had no previous involvement in your case or the matters being appealed. If there is a delay in providing a decision, then we will inform you of the delay together with the expected timescale for a decision to be provided.

14.5 If your appeal is upheld or partially upheld, the Academic Appeals Group will recommend that the relevant Board of Examiners or Award and Progression Panel reconsiders its original decision. This does not mean your marks will automatically change.

14.6 If your appeal is rejected as invalid, you may request a review of that decision by writing to the Governance and Legal Team at appealsandcomplaints@glos.ac.uk within 10 working days of receiving the outcome. The Chair will decide the most appropriate arrangements, taking account of the circumstances of the case.

15.9 The Panel will consider:

your appeal and the supporting evidence;

the decision of the Academic Appeals Group;

the response from the relevant School and, where appropriate, Professional Service;

the grounds on which the appeal has been referred to the Panel; and

any relevant information provided during the review process.

15.10 The panel may:

uphold the appeal;

partially uphold the appeal; or

not uphold the appeal.

15.11 If the appeal is upheld or partially upheld, the Panel will recommend that the relevant Board of Examiners or Award and Progression Panel reconsiders its original decision.
